These Terms and Conditions outline the rules and regulations for the use of our services. By choosing to work with us, you acknowledge that you have read, understood, and agree to be bound by these terms. Our commitment is to deliver exceptional quality in all our service areas while maintaining transparency and professionalism.
1. Acceptance of Terms
By engaging our services for Tile & Gypsum Installation, Welding & Metal Fabrication, Detailing, Painting & Finishes, Aluminium & Glass Partitions, Furniture Shop & Craftsmanship, or Interior Design, you agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not proceed with our services.
2. Services Provided
We offer professional construction and interior design services including but not limited to tile and gypsum installation, welding and metal fabrication, architectural detailing, painting and finishing work, aluminium and glass partition systems, custom furniture craftsmanship, and comprehensive interior design solutions. All services are subject to availability and project feasibility assessment.
3. Quotations and Pricing
All quotations are valid for 30 days from the date of issue unless otherwise specified. Prices are subject to change based on material costs, project scope modifications, or unforeseen site conditions. Final pricing will be confirmed in writing before commencement of work. Additional charges may apply for changes requested after project commencement.
4. Payment Terms
Payment schedules are typically structured as follows: 40% deposit upon contract signing, 30% at project midpoint, 20% upon substantial completion, and 10% upon final inspection and handover. All payments must be made within 7 days of invoice date. Late payments may incur interest charges of 2% per month. We reserve the right to suspend work for non-payment.
5. Project Timeline
Project timelines are estimates based on normal working conditions and material availability. We will make reasonable efforts to complete projects within agreed timeframes. Delays caused by weather, client-requested changes, material shortages, or force majeure events are excluded from guaranteed completion dates. Extensions may be granted with written notice.
6. Client Responsibilities
Clients must provide accurate site information, necessary permits, clear access to work areas, and timely approvals for design decisions. Failure to provide required information or access may result in project delays and additional costs. Clients are responsible for securing all necessary building permits and regulatory approvals unless otherwise agreed in writing.
7. Materials and Workmanship
We use quality materials from reputable suppliers and employ skilled craftsmen for all projects. Materials will meet industry standards unless specific alternatives are requested and approved. We guarantee our workmanship for a period of 12 months from project completion, excluding normal wear and tear or damage caused by misuse.
8. Changes and Variations
Any changes to the agreed scope of work must be requested in writing and will be subject to additional charges and timeline adjustments. We will provide written quotations for all variation work before proceeding. Verbal agreements for changes will not be recognized unless confirmed in writing by authorized personnel.
9. Warranty and Defects
We warrant that all work will be completed in a professional manner using appropriate materials. Defects in workmanship reported within 12 months will be rectified at no additional cost. This warranty does not cover damage from abuse, negligence, unauthorized modifications, or normal wear and tear. Manufacturer warranties on materials and fixtures are passed through to clients.
10. Limitation of Liability
Our liability is limited to the contract value of the specific project. We are not liable for indirect, consequential, or incidental damages including loss of profits, business interruption, or loss of use. Claims must be made in writing within 30 days of discovering the issue. We maintain appropriate insurance coverage for our operations.
11. Health and Safety
We maintain high health and safety standards on all project sites. Clients and their representatives must comply with site safety requirements when visiting work areas. We are not liable for injuries resulting from client non-compliance with safety protocols. All work areas will be maintained in a reasonably safe condition during project execution.
12. Intellectual Property
All design work, drawings, and specifications remain our intellectual property until full payment is received. Clients receive a license to use designs for the specific project only. Reproduction, modification, or use of designs for other projects requires written permission and may incur additional fees.
13. Termination
Either party may terminate the contract with 14 days written notice. Upon termination, clients are responsible for payment of all work completed and materials ordered. We reserve the right to immediate termination for non-payment or breach of contract. Termination fees may apply based on project stage and commitments made.
14. Dispute Resolution
Any disputes arising from these terms or our services will first be addressed through good faith negotiation. If resolution cannot be reached within 30 days, parties agree to mediation before pursuing legal action. These terms are governed by the laws of Kenya and disputes fall under the jurisdiction of Kenyan courts.
15. Privacy and Data Protection
We collect and process client information in accordance with applicable data protection laws. Client information is used solely for project execution, invoicing, and communication purposes. We do not share client information with third parties except as necessary for project completion or as required by law.
16. Force Majeure
We are not liable for delays or failures in performance resulting from circumstances beyond our reasonable control, including natural disasters, government actions, labor disputes, material shortages, pandemics, or other force majeure events. Timeline extensions will be granted for such delays without penalty.
17. Site Conditions
Quotations are based on site information provided by the client. Discovery of unexpected site conditions may require scope adjustments and additional costs. We will notify clients promptly of any such conditions and obtain approval before proceeding with additional work. Clients are responsible for disclosing known site issues.
18. Subcontractors
We reserve the right to engage qualified subcontractors for specialized work. All subcontractors are vetted and supervised to ensure quality standards are maintained. We remain responsible for overall project coordination and quality regardless of subcontractor involvement.
19. Insurance
We maintain appropriate public liability and professional indemnity insurance. Clients are responsible for insuring their property and contents. We recommend clients notify their insurers of construction work being undertaken. Proof of our insurance coverage can be provided upon request.
20. Amendments
We reserve the right to update these Terms and Conditions at any time. Changes will be posted on our website and apply to new contracts from the date of posting. Existing contracts will remain governed by the terms in effect at contract signing unless both parties agree to amendments in writing.
